ORDER UNDER SECTION 119 OF THE INCOME-TAX ACT, 1961

With a view to redress genuine hardship faced by the deductors due to the severe disruption of normal life and breakdown of communication systems caused by cyclone “Fani” hitting the state of Odisha on 3rd of May, 2019, the Central Board of Direct Taxes, in exercise of its powers under section 119 of the Income Tax Act, 1961, hereby-

(i) Extends the due date of depositing tax deducted at source (TDS) for the month of April, 2019 from 7th of May, 2019 to the 20th of May, 2019,

(ii) Extends the due date of filing of Quarterly Statement of TDS for the last quarter of financial year 2018-19 from 31st of May, 2019 to the 30th of June, 2019, and

(iii) Extends the due date for issue of TDS certificates in Form 16 and 16A from 15th of June, 2019 to 15th of July, 2019 in respect of deductors of the state of Odisha.

Sub: Engagement of Ex-Servicemen against vacancies in Safety Categories of Bridge Organization, Track Machine Organization and other similar technical safety Categories on Contract Basis.

Ref: No. 2018/Trans Cell/S&T/Contractual Staff, dated 20.11.2018.

1.0 Regarding, engagement of Ex Servicemen against vacancies in Safety Categories for Bridge Organization, Track Machine Organization and “other similar technical safety Categories” on Contract Basis following policy has been approved by Board (ME, MS, FC and CRB).

2.0 Zonal Railways with the approval of General Manager in consultation with PFAs. PCPOs and concerned PHODs may permit hiring of services of Ex-Servicemen on Contractual basis against sanctioned vacancies in Pay Grade Level 1 to 7 in Track Machines, Bridge and other similar technical safety categories.

The contractual hiring may be resorted to, for a limited period of time, till the vacancies are filled in through regular channel (RRBs, RRCs etc.), duly taking care of the safety and competencies required for a particular job.

The responsibility of Safety and Security however shall remain with the competent Railway Servant and the recruited Ex-Servicemen shall work under the guidance and supervision of regular Railway Servants.

The hiring of Ex-Servicemen may be done by either entering into suitable MOUs or other contractual arrangements as deemed fit with Defense Organizations engaged in resettlement of Ex-Servicemen.

3.0 The Contractual staffing is to be done against clear vacancies against direct recruitment quota. As soon as the vacancies are filled up by fresh recruitment or any other mode including compassionate ground appointments, the contractual engagement made through this channel should be reduced accordingly.

4.0 This scheme is launched on experimental basis and shall remain valid for 2 Years from the date of issue of this letter. Other conditions, as contained in letter under reference may be relied upon to the extent applicable in the instant case but the General Managers can modify these conditions keeping in view the local needs.

5.0 This issues with the concurrence of Associate Finance of Transformation Cell, Railway Board.

It is also noticed in some cases that age mentioned in the PPO differs from the date of birth/age mentioned in the LPC cum data sheet due to late submission of claim by ROs/HOOs and late notification of PPO as well.”

Sub: Payment of Additional Quantum of Pension to old pensioner.

Representations are being received from various Pension Disbursing Agencies(PDAs) seeking clarification as to from which date payment of additional quantum of pension to the armed forces service pensioners on attaining age of 80 years and above will be paid in cases where age shown in the PPO varies with the exact date of birth mentioned in the office records (i.e original discharge certificate).

The issue has been examined and it is noticed that in all old cases, there was a practice of mentioning the age of armed forces personnel instead of date of birth (though the date of birth was mentioned in LPC cum data sheet provided by the records offices).

It is also noticed in some cases that age mentioned in the PPO differs from the date of birth/age mentioned in the LPC cum data sheet due to late submission of claim by ROs/HOOs and late notification of PPO as well.

Accordingly, it has been decided that in all such cases where pensioner is not satisfied or PDA is not sure regarding date of commencement of additional pension, the cases may be referred to this office through ROs/HOOs concerned for issuing Corr. PPO for making necessary amendment.

CIRCULAR

While examining the Medical Reimbursement cases of the employees working in this Ministry, it is observed that Dr. Lal Path Lab is regularly overcharging Rs.1200/- against the CGHS prescribed rate of Rs.600/- for Dengue Serology test, even though the employee has valid CGHS prescription.

2. The matter was taken up with Ministry of Health & Family Welfare and as per their advice, it has been decided that a data of employees, who have paid an overcharged amount to Dr. Lal path Lab against Dengue serology test, would be prepared and sent to Dr. Lal path Labs to process the refund of excess charges levied against the said test.

3. It is hereby advised that employee, who has paid Rs.1200/- against Dengue IgG and Dengue lgM (Rs.600/-) tests conducted from Dr. Lal path Labs, may approach ERB-III branch within 30 days from date of issue of this letter along with copies of enlisted documents and required information in prescribed proforma attached herewith, to process his/her refund case.

The requests of refund shall not be entertained afterwards and the employee will have to approach directly to Dr. Lal Path labs for the same.

Please refer to this office letter of even no dated 22/02/2019 regarding admissibility / inadmissibility Of usage Of Staff Car / Higher Rate Of Transport Allowance in lieu of Staff Car by SAG and above IOFS officers drawing grade pay of Rs. 10000/ pay in pay level 14 and above.

In this connection, please find enclosed a copy Of CGDA Offce letter dated
25/04/2019 and Min of Defence ID No : (EsWGaz) dated 0804.2019 wherein it has finally been clarified that Officers Of IOFS cadre who are in the functional SAG level (not by means Of NFU) notwithstanding the fact that they are not HODS, are entitled to official car or higher rate of Transport Allowance in lieu of the official car as the case may be.

Therefore, all are requested to deal with the matter accordingly.

As per your basic pay on March, 2017, from the upgradation as MACP from 24/3/2017 advance increment fixed basic pay as Rs.74,300/(benefitted from 24/3/17) – (No increment on 1/7/2018 since increment will be given only annual or you can opt increment from 1/7/18). As per the annual increment rules 180 days should be completed in same level, (without any continues leave) next increment on 1/7/19 at Rs.75,600/- in level 9 is to be given.

Comment I have been granted MACP in new level 9 from the existing level 8 from 24.03.2017. My basic pay in level 8 in March 2017 was 72,100/-. My date of increment is 1st July. Please let me know, whether as per DoE OM dated 31.07.2018, which says “financial upgradation including upgradation under MACP during the period between 2nd day of Jan and 1st day of July (both inclusive) shall be granted on 1st day of January”, My new MACP fixation shall be fixed as on 01.01.2017 at 74300/- and 75600 as on 01.01.2017. should I give any option reg my next date of increment.

Since you have been opted from 1/4/16 additional increment you are not eligible on 1/7/16, DNI of will be 1/7/17 in next higher matrix level only as per Rule 10 of CCS, 2016. Increment is given on annual basis.

In my opinion as asked the question of SUKANAH GUHA, she requires continuous reimbursement in EMPHENALLED HOSPITALS it will not be allowed from the CGHS authorities. Only they will allow emergency cases & prescribed periods of such treatments. If they are having CGHS benefited they may reimburse the medical expenses such major diseases in any of the GOVERNMENT HOSPITALS, Tamil Nadu.

Comment The lacuna in implementing OROP is for the rank of Major, Lt. Cdr and Sqn. Ldr. as no Officer of above mentioned rank has retired after 2013. The OROP in letter and spirit is not applicable to this category of Officers. In number these Officers might be around 1000. Second problem with this category of Officers is that their service of 33 years has been truncated to 22 years on 01 July, 2014 thereby depriving them reduction in their pension by 33%. Hon PM and Defence Minister is requested to solve this anomaly. It can easily be solved by discussing with any Veteran of this Rank.

Comment BEFORE SOME MONTHS I HAVE EXPRESSED MY OPINION AND ALSO REQUESTED TO THE BJP GOVT. TO INCREASE THE RETIREMENT AGE FROM 60 TO 62 YEARS TO WIN THE ENSUING LOK SHABHA ELECTION-2019. BUT TILL NOW THE SAME HAS NOT BEEN INCREASED BY MR.MODIJI, OUR HONORABLE PRIME MINISTER OF INDIA. ON THE OTHER HAND, AS THE ELECTION IS KNOCKING THE DOOR OF BJP GOVT. RETIREMENT AGE OF ALL CENTRAL GOVERNMENT SHOULD BE INCREASED FROM 60 TO 62 YEARS FOR THE BJP GOVERNMENT FOR ANOTHER FIVE YEARS FOR SWACHHA INDIA.

Since you have been promoted from 1/4/13, July 13 increment was given from 1/4/13 onwards, so your next annual increment on 1/7/14 only..

You might have got MACP on 1/7/13 or 1/8/13 first in that rule there is some confusion that addition increment was given after basic pay on 30/6/13 as Rs.94,100 they have wrongly fixed as Rs.96900 in level 8. As per Min. of Finance O.M.No.4-21/2017-IC/E.III(A) dated 31/7/18 actually that increment is to be given on 1/7/14 only, but since you are retired on 31/8/13 (DNI is cannot be given) & your GP was increased it was fixed in level 9 after Rs.94100 next stage in that level is s.95,800/- so your pension was fixed 50% of basic pay as Rs.47,900/-. You might have been got basic pay plus GP 4800 from your MACP date. If it correct give a reply or give your basic pay as on 30/6/13.

Comment I retired on 31.8.13 in GP5400 in scale 9300.34800.Pay36960.Pension fixed 48450 in GP4600 which was wrong GP.On pointing out this Pension revised to 47900 in GP 5400.How can this be.Higher pension in lower GP and lower pension in higher GP.Is this an anamoly.Require help and guidence please

Pay Scale in 5th CPC 5500-175-9000 not upgraded as GP 4600 (it is GP 4200 only). Pay Scale of 6500-10500 upgraded as GP 4600 from 1/1/2006. Yours is 6550+4200 = 10750 x 2.57 = 27627.5 fixed at matrix level 6 as Rs.35,400 stage 1 & Notional Pension 50% as basic pension of Rs.17,700/- from 1/1/2016 plus D.R. as applicable rates from time to time.

Now officials of stage1 to upto 7th Stage B. P of all officials r fixed rs 17140. How the benefit of bunching would be regulated under 6th Pay commission. In above cases.
