Sub:- Clarification on fixation of Pay of Inspector Posts/Assistant Superintendents Posts in revised pay structure of 6th CPC consequent upon upgradation of Grade Pay of Inspector Posts Cadre from Rs.4200/- to Rs.4600/- w.e.f. 01.01.2006 – reg.

Sir,
This is regarding grant of benefit of ACP Scheme to the officials of Inspector Posts/Assistant Superintendents Posts cadre, who got promotion or earned financial upgradation under ACP Scheme, in lieu of promotion from Inspector Posts to Assistant Superintendents Posts cadre prior to 01.01.2006.

2. Various representations were received from Associations as well as Inspector Posts/Assistant Superintendents Post cadre officials and clarifications have been sought for by the Circles. The matter was taken up with the Department of Personnel & Training for seeking their advice. The DoP&T has advised vide their ID Note No. 1370679119/CR dated 10.06.2019 as under:-

“We have incorporated the modalities for entitlements for MACP in case of upgradation of pay scale of certain posts by the 7th CPC, in the consolidated instructions on MACP, which is going to be issued shortly.”

3. This may be brought to the notice of all concerned for their information.

Sub:-Modified Assured Career Progression Scheme (MACPS) for the Railways Employees-Benchmark Regarding.

Subsequent to acceptance of the recommendations of 7th CPC by the Government regarding raising the benchmark for performance appraisal for promotion and financial upgradation under MACPS from “Good” to ”Very Good”. Railway Board vide letter dated 19-12-2016 enhanced the benchmark for grant of financial upgradation under MACPS to ”Very Good” tor all posts.

These changes were made effective from 25th July. 2016 i.e. from the date of resolution notified by Department of Expenditure, Ministry of Finance regarding acceptance of the recommendations of 7th CPC.

2. On the demand raised by the Staff Side persistently in all forums including in the National Council (JCM) for revision of enhanced benchmark on prospective basis, the matter has been considered by the Board and it has been decided that APAR grading ”Good” for the period prior to 25-7-2016 i.e. the date from which the new Benchmark was made applicable. may be treated as ··very Good” while considering those cases of MACPS in which APARs for the said period are required to be taken into account.

3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Kind attention of Railway Board is invited to Federation’s letter dated 20/12/2018 on the subject wherein a copy of South Central Railway’s letter dated 15/19-11-2018 was forwarded to the Railway Board wherein the Zonal Railway sought clarification on the following points:-

1. Subsequently, as per Railway Board’s letter No. PC.III/84/UPG/19 dated 25/06/1985, cadre restructuring was implemented w.e.f. 0ll0lll984. It is pertinent to note that Para 5.3 of the said Railway Board’s letter dated 25/06/1985 laid down that the vacancies existing on 01/01/1984 and those arisen on that date as a result of cadre restructuring should be filled (i) from the panels approved on or before 30/06/1985 and current on that date and (ii) balance in the manner indicated in Paras 5.1 & 5.2 of the said letter.

2. The Zonal Railway further admitted that the employees who were already given the benefit of fitment against the 50% direct recruitment quota vacancies of Asst. Draftsman vide panel dated 16/01/1984 were erroneously given the restructuring benefit w.e.f. 01/01/1984 though they were not part of any unused panel of ADMs as on 30/06/1985 as prescribed in restructuring orders dated 25/06/1985.

From this, it is very clear that the serving Diploma Holder Tracers who were absorbed as Asst. Draftsman against 50% DR Quota vacancies on 20th January, 1984 in terms of Railway Board’s orders, their absorption against DR quota has to be reckoned for granting financial upgradation under MACPS as the entry Grade Pay of ADM/JE has been GP 42001- (6th CPC).

Federation feels disappointed to state that though a period of over four months has since passed, there is however no response from Railway Board.

Further Federation desires to state that the PNM Subject 15/2015 though could not be discussed in the NFIR’s PNM meeting held on 25th 26th April, 2016,Railway Board however in the Action Taken Statement delivered during the PNM meeting, conveyed that the matter is being reviewed in the light of discuassions held on 09/08/2018.

Federation has learnt that the Railway Board have since sent clarification to the General Manager (P), South Central Railway on this issue but however copy of the said communication has not been endorsed to the Federation.

NFIR, therefore, once again requests the Railway Board to kindly expedite action for allowing MACP in the instant case.

Subject: Modified Assured Career Progression Scheme (MACPS) for the Central Government Civilian Employees.

This is in reference to DoPT OM No.35034/3/2008-Estt(D) dated 19.05.2009 and OM No.35034/3/2015-Estt(D) dated 28.09.2016 (copies enclosed) regarding Modified Assured Career Progression Scheme (MACPS) for the Central Government Civilian Employees.

2. It has been decided to implement the aforesaid orders in the case of Group ‘C’ and ‘D’ employees who have opted for Government Service and working in Department of Telecommunications or on deemed deputation basis in BSNL/MTNL and to withdraw One Time Bound Promotion (OTBP) Scheme and the Biennial Cadre Review (BCR) Scheme w.e.f 01.09.2008.

Subject: Availability of option for fixation of pay on Modified Assured Career Progression Scheme (MACPS) from the date of next increment (DNI) in the lower post and method of pay fixation from DNI, if opted for, in Context of Army Pay Rules 2017. Air Force pay Rules 2017 and Navy pay Regulations 2017 in respect of ICOs/ORs and equivalent.

The undersigned is directed to refer to MOD OMs of even number dated 22.03.2018 and 26.02.2019 on the issue of availability of option for fixation of pay on promotion from the date of next increment (DNI) in the lower post and method of pay fixation from DNI, if opted for, in context of Army Pay Rules 2017.

Air Force pay Rules 2017 and Navy Pay Regulations 2017 and to say that the aforesaid OMs dated 22.03.2018 and 26.02.2019 will be applicable in the cases of pay fixation on grant of MACP also in respect of ICOs/ORs and equivalent.
