Sub: Setting up of NPS oversight mechanism

Timely credit of deduction made from the salary of Central Government employees towards their contribution to NPS along with the Government contribution is of paramount importance for availability of due and timely returns thereon towards generation of pension corpus.

Department of Expenditure vide their letter No.1(24)/EV/2016 dated 02.07.2019 has desired setting up of an oversight mechanism to ensure oversight over the NPS contributions crediting.

Accordingly, Board has decided that monitoring Committees, comprising of the following officers may be formed on each Railway/Unit:

1. FA&CAO in charge of NPS – Convener
2. Dy. CPO in charge of Bills & Settlement – Member
3. Dy. FA&CAO tn charge of NPS -Member

2. The Committee shall be responsible for the following actions:

(i) Ensuring that the contributions of employees and the Government are credited without delay to the NPS financial architecture both in case of existing employees and employees newly recruited from time to time and the existing system and procedure being followed for the purpose shall be monitored effectively to ensure that no delay in credit of the contributions takes place.

(ii) Ensuring that in case any grievance by any employee is received in regard to delay in credit of contribution, either directly from the employee or through PFRDA, the same has been looked into and disposed of in a manner to the satisfaction of the concerned employees.

(iii) Any other matter as having a bearing on the issue of crediting/remittance of NPS contributions.

(iv) The Committee shall devise its own mechanism as also appropriate checks and balances to ensure that NPS contributions are credited on time in respect of all employees under NPS system.

(v) The Committee shall meet at least once in 3 months to review the progress and in case any slippages are notices, it shall take immediate corrective action. However, the concerned Principal FA and Pr. CPO shall keep a watch over the progress on a regular basis.

The Committee shall oversee implementation of the NPS system as per action points brought out above and send status report on quarterly basis by 5th of the month following each quarter (i.e.. 5th April, 5th July, 5th October and 5th January) highlighting the result of the monitoring with concluding remarks whether the NPS contributions are being credited on time and in case of any slippages, the details of action taken for the same.

The names of the officers nominated in the Committee may be advised to Railway Board along with their mobile no. and email id. latest by 25th July, 2019.

With referecen to the demand of the NFIR on the aove mentioned subject regarding provision of more numbers of seats for wards of Railway Employees during admission in Project Sector KVS.

The issue has been examined in the PNM/NFIR meeting and it has been decided that all Zonal Railways where Project Sectro Kendriay Vidyalaya are operational should reserve 20% seats exclusively for the wards of Railway employees at the time of admission.

Federation vide letter dated 30.03.2019 had requested the Railway Board to formulate proposal for allotment of Qualification based Pay Matrix to the ECG Technicians of Railway Hospitals and obtain clearance of Ministry of Health & Family Welfare and the MOF.

In continuation, the Federation desires to place following additional points for making out comprehensive proposal:-

I. Federation has undertaken a comparative study duly comparing the Recruitment qualification and Scales of pay allotted to the ECG Technicians working at Dr. Ram Manohar Lohia Hospital,Delhi under Ministry of Health & Family Welfare with that of ECG Technicians of Railway Hospitals.

A report running into three sheets from the periods of Previous Central Pay Commissions i.e. 3rd CPC to 7th CPC is attached to this letter as Annexure ‘A’ to this letter.

II. A careful study of the comparison mentioned in Annexure ” A” would reveal as under:-
(a) The ECG Technicians appointed in Dr. Ram Manohar Lohia Hospital, New Delhi (under Ministry of Health and Family Welfare) have never been in possession of the standard qualification relating to the job expected from an ECG Technician, while in Railways, the ECG Technicians possess “Diploma in ECG Lab Technology”.

(b) ECG Technicians in Railways have never been treated atleast equal to those working in the Central Government Hospitals and have rather been treated inferior. This situation has been prevailing since the period of 3rd CPC.

(c) The DR qualification prescribed for the post of Sr. ECG Technician in Dr. Ram Manohar Lohia Hospital for Gr. Rs. 1400-2600 (IV CPC)/5000-8000 )V CPC)/PB-2 GP 4200 (VI CPC)/Pay Level-6 in 7th CPC is Bachelor’s Degree in Science with Physics with one year’s experience in handling cardiological equipment or 3 years Diploma Course in Electronics/Electrical communication Engineering (VI CPC).

Whereas in Railways, though the qualification for the post of ECG Technician got revised during 6th CPC regime to Degree in Science plus Diploma in ECG Lab Technology/Cardiology/Cardiology Technician/Cardiology Techniques of reputed institution

[refer Railway Board’s letter No. E(NG)II/2001/RR/45 Pt. A dated 29/09/2015], unfortunately they have not been treated at par with those ECG Technicians of Dr. Ram Manohar Lohia Hospital.

III. In addition to above, Federation desires to bring to the notice of Railway Board that in the ESIC Model Hospital cum ODC, MIDC, Andheri (E), Mumbai-93 under the Ministry of Labour, Government of India, vide recruitment notice published in Employment News (8-14 August 2009) the qualification prescribed for the post of ECG Technician in PB-1 + GP 2800 is as under:-

“Preferably Science Graduate or Matriculation or Equivalent. Should have experience of 1 year of handling ECG Machine”.
Copy of the said Recruitment notification is enclosed as Annexure ‘B’.

IV. Similarly, the Director General, Border Security Force under Ministry Home Affairs vide Recruitment notification No. A3/Pers (RectO/PMS-Advt/BSF/2010 for Para Medical Staff has prescribed the following qualification to the post of Asstt. Sub-Inspector (ECG Technician) in PB1+GP 2800:-

“Matriculation or equivalent qualification from a recognized Board with experience of handling Electronic Cardio Graphics Machine for one year from a reputed institute”.

Copy of the above notification is attached as Annexure ‘C’.

V. The above points are sufficient to prove that on Indian Railways while the ECG Technicians are with higher qualifications than the ECG Technicians in the Central Government Hospital

(Dr. Ram Manohar Lohia Hospital, Delhi) and other Government Hospitals, unfortunately, the Railway ECG Technicians have been treated unfairly by the successive Central Pay Commissions, although they deserved placement in PB-2+GP 4200.

Federation also desires to state that the qualification prescribed for ECG Technician in Dr. Ram Manohar Lohia Hospital, Delhi and other Central Government Hospitals is Polytechnic Diploma which is not at all relevant with the post of ECG Technicians.

VI. Federation incidentally mentions that the duty list of ECG Technicians (vide Para 202 (33) of IRMM-2000 vide S. No. 1 Health 2003) is as under:-
(a) Take all Routine and Emergency ECG’s.
(b) Assist Doctor in performing:-
(i) Master ECG
(ii) Treadmill Test
(iii) Holter Recording
(iv) Echocardiography
(c) Will assist in maintenance of equipments, AMC, all records pertaining to the procedures and equipments, Statistical data, making appointments, instructions to patients regarding part preparation etc.,
(d) Performing any other duties as may be assigned by the Administration from time to time.

(Authority : Railway Board’s letter No. 2012/H-1/10/6 dated 18/04/2013).

VII. Another point which needs to be admitted is that there is no channel of promotion at all for ECG Technicians in Railways and they are forced to retire in the same recruitment Grade Pay/Pay Level while those recruited in other cadres with lesser qualification in the posts of Pay Level-1 get promoted to GP 2800 and also upto GP 4200, but sadly similar opportunities are not provided for ECG Technicians in Railways.

VIII. Summing up, NFIR requests the Railway Board to kindly review the pay structure of Railway ECG Technicians denovo for providing cadre structure with entry GP 4200+PB-2/Pay Level 6 with further avenue to GP 4600+PB-2/Pay Level-7 similar to Dr. Ram Manohar Lohia Hospital, New Delhi and obtain clearance of Ministry of Health & Family Welfare and MoF accordingly for implementation.

A copy of the proposal being sent to Ministry of Health and Family Welfare/Ministry of Finance may be made available to the Federation for follow up action.

MACP to to Station Master category in Railways – NFIR

Sub: Reckoning Grade Pay Rs. 4200/Level 6 of 7th CPC Pay Matrix as entry Grade pay for granting financial upgradation under MACPS to Station Master category in Railways-reg.

Ref: (i) NFIR’s PNM Item No. 15/2017.

(ii) Railway Board’s letter No. PCVII/2016/RSRP/2 dated 02/08/2016 [Annexure-B Note 2/RBE No. 93/2016].

(iii) Railway Board’s letter No. PC-V/2009/ACP/2 dated 10/06/2009.

(iv) NFIR’s letter No. IV/NFIR/MACPS/2009/Part 11 dated 28/08/2017 & 04/01/2018.

(v) NFIR’s letter No. IV/MACPS/09/Part 11 dated 29/01/2018.

Kind attention of Railway Board is invited to Federation’s PNM Agenda Item No. 15/2O17, proposing grant of 3’d financial upgradation under MACP Scheme to the Station Masters entered in GP 2800 which got merged with GP 4200/Leve1-6 w.e.f. 0110112016 vide Railway Board’s instructions dated 02/08/2016 (RBE No. 93/2016), pursuant to acceptance of 7th CPC recommendation.

Federation is however disappointed that the Railway Board has not yet considered for granting GP 5400/Level-9 as financial upgradation to those Station Masters who have completed 30 years of service.

Federation has however learnt that the Railway Board vide letter No. PC-V/2009/ACP/5/CR dated 11/12/2017 has issued a clarification to the General Manager (P), Central Railway stating that the upgradation of ASM in GP 2800 to the post of SM in GP 4200 has to be counted as promotion for the purpose of MACPS and therefore the GP 4200 (now Pay Level-6) cannot be treated as entry Grade.

This clarification of the Railway Board is totally unjustified due to the fact that the said decision violates policy instructions as mentioned below:-

The Railway Board have cited Item No. 31 of Board’s letter No. PC-V/99/I/1/1 dated,19/02/2002 to deny the benefit. The Federation on going through the contents of Item No. 31 of Board’s letter dated, 19 /02/2002 found following provision.

*Where all the posts are placed in a higher scale of pay, with or without a change in the designation; without requirement of any new qualification for holding the post in the higher grade, not specified in the Recruitment Rules for the existing post, and without involving any change in responsibilities and duties, then placement of all the incumbents against such upgraded posts is not be treated as promotion/upgradation”.

Since the upgradation of ASMs GP 2800 to GP 4200 as SM has been done as a result of acceptance of 7th CPC recommendation by the Government with slight change in the designation but without change in the qualification and any change in responsibilities and duties, therefore, the placement of all such incumbents against the upgraded posts cannot be treated as promotion/upgradation.

Federation further desires to clarify that the later part of the conditions mentioned against Item No. 31 are not at all relevant to the case of Station Master category

Further in Board’s letter dated 02/08/2016 (93/2016), it has clearly been mentioned vide Item No.2.1 of Annexure ‘B’ that in the case of ASMs GP 2800, their Grade Pay has to be revised to GP 4200′ therefore they are to be fitted in Pay Level-6 of 7th CPC.

Note at Item No. 2 clearly states that ASMs in GP 2800 should be upgraded to 4200 and then fitted in the revised pay Matrix and the designation of ASM shall stand abolished and the post of ASMs shall stand merged with the post of Station Master (GP 4200) along with functions.

However, the Note further states that the revised AVC, inter-se-seniority, recruitment rules, classification as decided by the Board, will be issued through separate letters. There are no instructions to treat such upgradation as promotion particularly for those ASMs who have been recruited in GP 2800/-.

Federation also brings to the notice of Railway Board the condition no. 5 mentioned in Annexure to Board’s letter dated 10/06/2009 (RBE No. 101/2009) which stipulates as under:-

(Promotions earned/upgradations granted under the ACP Scheme in the past to those grades which now carry the same Grade Pay due to merger of pay scales/upgradations of posts – by the 6th Pay Commission shall be ignored for the purpose of granting, upgradation under MACPS”,

Federation further states that based on the above provision, Railway Board have issued clarification vide letter dated 10/12/2009 (RBE No. 17/2009), that on the analogy of Para 5 of the Annexure to Board’s letter dated 10/06/2009, that promotions earned or upgradations granted under ACP Scheme of 01/10/1999 in the past to the four pay scales mentioned above, which now carry the Grade pay of Rs. 1800 shall be ignored for the purpose of MACPS.

Federation requests the Railway Board to kindly review the case denovo, taking into account the points raised above as also the PNM Agenda Item No. 15/2017 and grant 3rd MACP to the Station Masters in GP 5400/- Pay Level-9 on completion of 30 years service.

The subject will be discussed in the ensuing PNM meeting with the Railway Board on 25th/26th April. 2019.

Please find enclosed copy of reply dated 22/03/2019 received from the Railway Board on Federation’s demand dated 30/11/2018.

The Federation has, however, wrote back to the Railway Board on 01/04/2019 contending that the entitlement of higher class privilege pass to those in lower pay levels was allowed without any dilution till December 2010.

Therefore the right of the employees for higher class privilege pass entitlement should have been continued as was done in the past despite issuance of revised entitlements vide Board’s letter dated 06th January, 2011. However, Board’s response on Federation’s letter dated 01’st April, 2019 has not yet been received.

Copy of Federation’s letters dated (30/11/2018 & 01/04/2019) are enclosed to facilitate the affiliated Unions to convey at field level the efforts initiated by NFIR for getting higher class privilege pass entitlement to those employees who are in the below GP 4200/Pay Level-6 in Railways and entitled for higher class privilege pass as per their Basic Pay but for Board’s order dated 06th January, 2011.

Sub: NFIR’s Meeting with Chairman, Railway Board on 11th April, 2019-reg.

The affiliates are advised that the NFIR leaders (President, General Secretary and Joint General Secretary Shri B.C. Sharma) met Railway Board Chairman Shri V.K. Yadav on 11nd April, 2019 and discussed the subjects listed below:-

(a) LARSGESS: Need for granting appointment to the wards of safety category staff selected/medically found fit prior to 27th October, 2017.

CRB’s response: This matter is being pursued on daily basis for finding solution being legal matter wherein Legal Opinion/AG’s Opinion to be obtained for solving the problem.

NFIR however requested to see that Railway Board accords approval for appointment of wards presently waiting with anxiety.

(b) Quasi Administrative Unit Staff: CRB’s attention was invited to NFIR’s note vide No.II/1B/2018 dated 12/03/2019 and requested to see that Railway Board considers absorption of Quasi Administrative Unit Staff in view of the fact that these staff are being appointed by the management headed by Officer of the rank of not lower than JA Grade.

CRB’s response: CRB said that he will look into the matter again.

(c) Metro Railway, Kolkata – granting Zonal Railway status to RPF Department:

NFIR explained that all Departments of Metro Railway, Kolkata are functioning independently under the overall control of General Manager, Metro Railway while the RPF Department of Metro Railway is continued to be part of Eastern Railway and in this context NFIR conveyed that the General Manager, Metro Railway, Kolkata also wrote to Railway Board to accord independent Zonal Railway status to RPF wing of Metro Railway, Kolkata.

CRB has assured to take necessary action for treating RPF Department as independent Zonal Railway Organization under the command of PCSC, Metro Railway, Kolkata and under the overall control of General Manager, Metro Railway.

(d) Deployment of RPF Ministerial Staff to other Departments on option basis as per their request – implementation of the decision arrived at in the Joint Meeting:

NFIR reminded the CRB of its letter dated 11/02/2019 and back round of the case with ‘ request to give approval.

CRB said that the papers are with him and matter is under consideration.
