Anomaly in fixation of pay of Chief Loco Inspectors in Railways

Anomaly in fixation of pay of Chief Loco Inspectors appointed prior to 01.01.2016 – RBE No. 133/2019

PC-VII/ 143
RBE No.133/2019

GOVERNMENT OF INDIA
MINISTRY OF RAILWAYS
(RAILWAY BOARD)

No.E(P&A)II/2017/RS-06

New Delhi, dated 16.08.2019

The General Manager,
AU Indian Railways &
Production Units.

Sub : Anomaly in fixation of pay of Chief Loco Inspectors appointed prior to 01.01.2016 with reference to their juniors appointed after 01.01.2016 and drawing more pay than the seniors.

It has come to the notice of the Board that staff appointed prior to 1.1.2016 as Chief Loco Inspectors in the pre-revised pay structure, whose pay has been fixed in the 7th CPC pay structure for Chief Loco Inspectors under the RS(RP) Rules, 2016, are drawing less pay than their juniors appointed to the Supervisory post after 1.1.2016.

The anomaly has arisen due to the fact that the benefit of pay element granted at the time of promotion of running staff to a stationary post has been granted to the junior in the revised pay structure, whereas, the same benefit granted to the senior is of lesser value as the same has been calculated on pre-revised pay structure.

2. Rule 7(10) of RS(RP) Rules: 2016 contains the provisions for stepping up of pay in case of anomaly in pay fixation between senior and junior employees, subject to certain conditions.

The anomaly in the case of Chief Loco Inspectors has arisen due the benefit of pay element reckoned for fixation of pay on promotion of running staff to a stationary post being granted in pre-revised pay structure or revised pay structure.

3. Therefore, in accordance with Rule 7(10) ofRS(RP) Rules, 2016, it has been decided that the anomaly be resolved by granting stepping up of pay to the seniors at par with the juniors subject to the following conditions:-

(a) Both the junior and the senior Railway servants should belong to the same cadre from which they have been promoted to the higher post and the posts in which they have been promoted should be identical in the same cadre;

(b) The existing pay structure and the revised pay structure of the lower and higher posts in which they are entitled to draw are identical;

(c) The senior Railway servants at the time of promotion are drawing equal or more pay than the junior;

(d) The stepping up of pay will be allowed to running staff appointed as Chief Loco Inspectors only in whose cases extant quantum of pay element (at present 30%) is reckoned for pay fixation. The stepping up of pay will not be admissible to the non-running staff appointed as Loco Running Supervisors as in their cases the question of pay element in the running allowance does not arise;

(e) If even in the lower post, revised or pre-revised, the junior was drawing more pay than the senior by virtue of advance increments granted to him or otherwise, stepping up will not be permissible;

(f) In cases where the conditions are not met, stepping up of pay would not be admissible. For instance a Chief Loco Inspector promoted from Loco Pilot (Goods) prior to 1.1.2016 and the junior promoted to Chief Loco Inspector from Loco Pilot (Passenger) or from Loco Pilot (Mail/Express) [i.e. from a different post/cadre] after 1.1 .2016 are not identical and such would not come under the purview of instructions relating to stepping up of pay.

(g) In this connection, it is stated that LP (Goods), LP (Passenger) and LP (M/E) form three different and distinct seniority units and would, therefore, constitute different cadres/posts in the context of clause (a) above as clearly brought out in (f) above.

(h) Stepping up will be allowed only once, the pay so fixed after stepping up will remain unchanged;

(i) The senior shall be entitled to the next increment on completion of his required qualifying service with effect from the date of refixation of pay.

4. This has the approval of the Finance Directorate of the Ministry of Railways.

LDCE DR Quota: 20% vacancies of OS-IT and 13.33 % vacancies of Senior Clerk

Scheme of LDCE for filling up 20% vacancies of OS-IT and 13.33 % vacancies of Senior Clerk – RBE No. 78/2019

RBE No. 78/2019

GOVERNMENT OF INDIA
MINISTRY OF RAILWAYS
(RAILWAY BOARD)

No.E(NG)/I/2018/PM 1/19

New Delhi, dated May 10, 2019

The General Managers (P),
All Zonal Railways &
Production Units
(as per standard mailing list)

Sub: Scheme of LDCE for filling up 20% vacancies of OS-IT and 13.33 % vacancies of Senior Clerk.

Attention is invited to RBE No.102/2005 vide which the 20% DR quota that was introduced for, inter-alia OS-II, was decided to be operated instead as an LDCE quota open to all Graduate serving employees with prescribed residency period.

The written exam (Railway wise) was to be conducted by RRB Vide RBE No.147/2006, the conduct of the exam was shifted from RRBs to respective Zonal Railways themselves. Vide RBE No. 110/2016, conduct of Senior Clerk LDCE (13.33% quota) was also handed over from RRBs to Zonal Railways.

The conducting of the OS-II and Senior Clerk LDCEs has however been centralized in each Railway so far, meaning thereby that vacancies of all Departments and all Divisions are clubbed together for a common exam and panel.

Railways have however, been raising this issue of centralized LDCE for these categories periodically, pointing out that with MACP in place, volunteers for OS-II and Senior Clerk LDCE are scarce due to the risk of inter-divisional transfer in a centralized panel scenario, which results in a number of vacancies remaining unfilled.

The matter has accordingly been reviewed in consultation with the Zonal Railways and it has been decided that the LDCE for both the OS-II and Senior Clerks may be decentralized, by holding the exam at the Divisional level by clubbing the vacancies of all the departments.

This decentralization will be in respect of Divisionally controlled cadres/ seniority units for these posts.

Please acknowledge receipt.

Career Progression of the Staff Working in GP 1800

Career progression of the staff working in GP Rs.1800
All India Railwaymen’s Federation

No.AIRF/24(C)

Dated: December 8, 2018

The Chairman,
Railway Board,
New Delhi

Sub: Career progression of the staff working in GP Rs.1800

Dear Sir,
As I have discussed this issue personally with your goodself and tried to get resolved the issue regarding career progression of the staff working in GP Rs.1800;

Because in many departments; the employees working in GP Rs.1800 are stagnating in GP Rs.1800 for 15 years and even 20 years, and these are the staff those who are working in GP Rs.1800 are virtually doing the job of skilled nature, in almost all the departments, including Technical and Non-Technical.

It would be in all fairness if 50% posts of GP Rs.1800 should be upgraded to GP Rs.1900, which will resolve the problems of the Railway Industry as well as the employees.

In this connection, it is worth-mentioning that, we have also requested your goodself for reduction in the Direct Recruitment Quota, and the employees having qualification of RRB should be given benefit for their selection against those vacancies through “LDCE open to all” policy, to facilitate the highly educated staff available over the Indian Railways.

We sincerely hope that, you will kindly consider it favourably and do the needful.

Yours faithfully,

Meeting Held on 7.12.2018 with Railway Minister – AIRF

Brief of the meeting held on 07.12.2018 with Hon’ble Minister for Railways

Dated: December 8, 2018

The General Secretaries,
All Affiliated Unions,

Sub: Brief of the meeting held on 07.12.2018 with Hon’ble Minister for Railways

Dear Comrades,
Yesterday I met Hon’ble Minister for Railways and shown our anguish against the inordinate delay in resolving the problems of the Railwaymen at an earliest. We have also mentioned about the discussions held with the Railway Board on 4-5 December, 2018 and our decision of “Work To Rule”.

He had given positive response and called the Member Staff and Financial Commissioner(Railways), Railway Board, telling them to resolve the problems of the Railwaymen at an earliest, including implementation of four grade structure, in the ratio of 10:20:20:50, in case of Trackmen/Track Maintainers, revision of the rates of Running Allowance and other allowances related to Running Staff, Restructuring of the IT Cadre, etc. etc.

The meeting was held in a very cordial atmosphere and Hon’ble MR had appreciated the sentiments of the Railwaymen organized under AIRF.
This is for your information.

Yours faithfully,

Pending burning issues of the Railwaymen

The under noted burning issues have been time and again brought to your kind notice for early redressal thereof because non-redressal of these issue is causing serious deep sense of discontentment among the Railway Staff……

1.Implementation of four grade structure in the ratio of 10:20:20:50 in case of Trackmen/Track Maintainers – As you are very well aware that, the Joint Committee on Package and Career Progression of Trackmen had, unanimously recommended to grant four grade structure to the category of Trackmen/Track Maintainers in the ratio of 10:20:20:50 with a view to facilitate advancement prospects to this ever neglected category of the staff who are directly involved in safe train operation by maintaining railway track.

Despite assurance given by the Railway Board, during the course of discussions in Railway Board PNM with AIRF, that, orders would be issued within a couple of days to implement the said four grade structure, final outcome is still awaited, due to which serious resentment is brewing among the Trackmen/Track Maintainers.

2.Revision of the rates of Running Allowance and other allowances related to Running Staff – This issue has also been deliberated at length at several occasions, but unfortunately, Railway Board’s instructions to this effect are yet to be issued.

The Running Staff, both Loco & Traffic, are seriously concerned due to inordinate delay in revision of the rates of Running Allowance and other allowances related to Running Staff because on previous occasions the revision used to be done just after implementation of recommendations of the successive Central Pay Commissions.

I would, therefore, seek your personal intervene, so that, revision of the rates of the aforesaid allowances is done without any further delay.

3.Restructuring of the IT Cadre – Information Technology has gained paramount importance in all walks of the life. While IT Cadre was formed in the Indian Railways more than a decade ago, but there is still some confusion in regard to dysfunction and Human Resource Management.

Railway Board had issued instructions for Cadre Restructuring of IT Cadre (Ref.No.2016/AC-II(CC)/37/9 dated 18.04.2017(RBA No.45/2017), No.2017/AC-II(CC)/37/7 dated 29.06.2017 and No.2017/AC-II/37/9 dated 29.12.2017), but unfortunately, an impracticable condition was imposed to surrender all the vacant posts in the cadre, whereas, in Cadre Restructuring of other categories, only number of posts of Matching Money Value were surrendered and not the entire vacant posts.

We have been regularly pursuing this issue, and the present Financial Commissioner, Railway Board, also assured to take necessary action in the matter, but final outcome is still awaited.

I would, therefore, request that, this issue should also be looked into on priority and revised orders issued early.

I sincerely hope that, the above issues would definitely be given due attention and necessary instructions shall be issued without any further delay, keeping in view the discontentment brewing among these vulnerable categories of the Railwaymen.

Hon’ble MR wanted certain clarifications from the Engineering Directorate, and the same has been submitted by the said Directorate for approval of Hon’ble MR.

2. Revision of the rates of Running Allowance and other Allowances related to Running Staff – After lengthy discussions; the Member Staff informed that, the file is put-up to Hon’ble MR for his approval, and after his approval, the file would be sent to the MoF. It was informed by the Member Staff, Railway Board, that the concerning file is with Hon’ble MR for his approval.
Continuance of the LARSGESS – It was informed to AIRF that, the Railway Board have revisited the scheme, and the same will be submitted to Hon’ble Supreme Court in consultation with the Solicitor General, Government of India. Hon’ble Supreme Court has granted one-month time to the Railway Ministry for filing reply.

2. Advancement of prospects of the staff working in erstwhile GP Rs.1800 and GP Rs.4600- After prolonged discussions, Member Staff, Railway Board, agreed with the views of AIRF that, there is stagnation of the staff working in erstwhile GP Rs.1800.

AIRF has suggested that 50% posts in GP Rs.1800 should be upgraded to GP Rs.1900 to provide advancement to the staff, so that, the benefit to the staff who is stagnated in GP Rs.1800 for a long period, can be extended.

AIRF has also pointed out that, 10% posts of DR Quota in various categories should be converted into LDCE and promotional benefits should be given to the higher educated staff of various categories, including Track Maintainers. This should be in addition to LDCE Quota, already provided in the respective categories.

3. Non-revision of rates of Incentive Bonus/Bonus Factor and PCO Allowance paid to Technical Staff and Supervisors of the PUs and Maintenance Workshops – It was assured by the Railway Board that a concluded final proposal will be given to the Federation within a week, and a meeting to finalize the revised rates of Incentive Bonus/Bonus Factor will be called for soon.

4. Upgradation of the Apex level of Group `C’ to Group `B’ – AIRF insisted that, powers are vested with the Railway Board to grant upgradation for the apex grade Supervisors to Group `B’.

This was also confirmed by the Finance Secretary(Exp.) on the previous occasion, and the minutes of the said meeting given to the Railway Board. In spite of that, the matter is dragged by the Railway Board by sending proposal to the MoF.

The Federation(AIRF) insisted that, decision should be taken at the Railway Board level itself. Member Staff directed the AM(S) to put-up all the particulars, including the minutes of the meeting of the Standing Committee(JCM) for taking a decision as Railway Board primarily agreed to give Gazetted status to the Supervisors working in GP Rs.4800 and Rs.5400.

The Federation(AIRF) insisted that, as per the Act and Codal Provisions as well as Transaction of Business Rules, the powers are vested in the Railway Ministry and they should not run to the DoP&T and MoF.

5. Regularization of the Act Apprentices in Railways – AIRF demanded that, all the Act Apprentices imparted training in the Railways should be absorbed in the Railways.

It was explained to the Member Staff that the orders were available previously, but unfortunately, Board have issued orders on 20.06.2016 and implemented the orders with back date, depriving the Act Apprentices from the absorption in the Railways.

The Federation demanded that, new Apprentices Act, passed by the Parliament, has given full powers to decide procedure for absorption of these Act Apprentices. Federation demanded that, Screening Type system should be adopted for absorption of the Act Apprentices.

The Member Staff agreed to study the problem after finalization of the present RRC examination.

6. Engagement of the Act Apprentices in Railways – AIRF demanded that, the old practice, prevailing in various Workshops/Divisions, should be continued. The AM(Staff) assured to examine the issue and necessary instructions will be issued.

7. Restructuring of the IT Cadre – After prolonged discussions Board was agreed with the view of AIRF that restructuring should be carried out on the sanctioned strength and not on the role.

Similarly, vacant posts in the cadre will not be freezed as was instructed in the earlier notification of restructuring of the cadre. The principle of “Financial Neutrality” will be adopted as followed in other cadre restructuring.

It was also agreed that, looking the various aspects of GST, Digitalization and wide scope of the IT Cadre related solutions, there is a need of cadre strengthening of the IT Cadre over the Indian Railways.

8. NPS – The Board apprised that, earlier proposal sent by the Railway Board to the MoF was returned unapproved, giving example of the Paramilitary Forces as also huge strength of the Railwaymen. AIRF insisted that the proposal, reflecting the sensitive working of the Railwaymen, should again be sent to MoF, which was agreed to by the Official Side(Railway Board).

9. Quasi – After prolonged discussions Board agreed to re-examine the issue.

10. Hard Duty and Risk Allowance to various categories of staff – The Board apprised the Federation(AIRF) that, a comprehensive proposal, covering various Safety Categories, is under consolidation, as suggested by AIRF. The matter will be referred to the MoF later.

11.Duty Hours of Running and other Safety Categories Staff – After prolonged discussions, Member Staff apprised the Federation(AIRF) that the present recruitment process is in active mode and a panel is expected by the end of February 2019 or so, and thus the problem of the Running Staff as well as Safety Categories Staff will come to an ease since it is due to shortage of the staff because of no recruitment’s in past few years. On the demand of AIRF, the Member Staff agreed to send the roadmap for future recruitment.

He also informed that, in future, all Group `C’ recruitments through RRB will be dealt by the Zonal Railways with their respective RRBs directly. He also conceded the demand of AIRF about delegating the powers for recruitment of the staff in GP Rs.1800 to the respective Zonal Railway Headquarters.

12. Headquarters/Outstation Rest of the Running Staff – AIRF strongly protested the unilateral withdrawal of the decision, arrived at after prolonged discussions in the PNM Meeting of AIRF with the Railway Board, without any consultation with the Federation.

The Member Staff mentioned that, the compelling situation in detail will be provided to the Federation(AIRF), however, the matter will be looked into.
