Office Memorandum

Subject: Exemption from payment of examination fee and application fee in respect of Persons with Benchmark Disabilities. -reg.

The undersigned is directed to say that in a w.P. (Civil) No. 521/2008 with Civil Appeal No. 5389/2016, the Hon’ble Supreme Court, vide Judgment, dated 30.06.2016, inter alia, declared the Office Memorandum No. 36035/3/2004 – Estt.(Res) dated 29.12.2005, as illegal and inconsistence with the Persons with Disability (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. This OM, among other, contained a provision for exemption from payment of application fee and examination fee in respect of Persons with Disabilities.

2. Thereafter, with the enactment of ‘THE RIGHTS OF PERSONS WITH DISABILITIES ACT, 2016’ and issue of notification titled ‘THE RIGHTS OF PERSONS WITH DISABILITIES RULES, 2017’, this Department has issued an Office Memorandum No. 36035/2/2017-Estt.(Res), dated 15.01.2018, regarding reservation for Persons with Benchmark Disabilities, in the posts and services of the Central Government.

The said Office Memorandum dated 15.01.2018, however, does not contain any provision for exemption from payment of examination and application fee in respect of Persons with Benchmark Disabilities.

3. The issue has been deliberated upon at length in the Department and it has, now, been decided that the Persons with Benchmark Disabilities shall continue to be exempted from payment of application fee and examination fee, prescribed in respect of competitive examinations held by the Staff Selection Commission, the Union Public Service Commission, etc. for recruitment to various posts.

This exemption shall be available only to such persons who would otherwise be eligible for appointment to the post on the basis of standards of medical fitness prescribed for that post (including any concession specifically extended to the Persons with Benchmark Disabilities) and who enclose with the application form, necessary certificate from a competent authority in support of their claim of disability.

SUBJECT: Furnishing of OBC data of recruitment to Commission for SubCategorization of OBC – regarding.

The undersigned is directed to refer to this Division’s OM of even number dated 20.02.2018, 27.02.2018, 21.03.2018 and 31.12.2018 on the above mentioned above subject matter and to state that on scrutiny of the data available on CSCMS portal,

it is observed that many Ministries/Departments have not yet updated the information with reference to Categorization/Sub Categorization of a BC officers, along with the data relating to the “State” from which OBC candidates appeared/selected in respect of CSS cadre (ASO to JS-insitu) in the CSCMS portal.

2. As the data is urgently required by the Commission for Sub-Categorization of aBC Officers, the concerned Ministries/Departments are once again requested to take up immediate necessary steps for updating the information, in the CSCMS portal compulsorily, by 18th of January, 2019 (Friday).

The Nodal Officers of concerned Ministry/Department are authorized to update the data in CSCMS portal. The concerned Officers may also be sensitized to get their data updated in the system, in a time bound manner.

3. In case of any doubt/difficulty about the functioning of the CSCMS portal/Correctness of data in the CSCMS, Shri Krishnandan Kumar, ASO (PR/CMS)/Shri Anuj Pratap Singh (Engineer/CMS)/ may be contacted at Telephone 24629890/24629414.

4. This may be accorded, “TOP MOST PRIORITY”.

Amendment in Central Civil Services (Leave) Rules, 1972

Notification on leave as per 7th CPC’s recommendations

MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training)

NOTIFICATION

New Delhi, the 11th December, 2018

G.S.R. 1209(E).— In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely:-

1. (1) These rules may be called the Central Civil Services (Leave) (Fourth Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Civil Services (Leave) Rules, 1972,

(A) in rule 28, in sub-rule (1) for clauses (a), (b) and (c), the following clauses shall be substituted, namely:-

“(a) The leave account of every Government servant (other than a military officer) who is serving in a Vacation Department shall be credited with earned leave, in advance’ in two installments of five days each on the first day of January and July of every calendar year.

(b) In respect of any year in which a Government Servant avails a portion of the vacation, he shall be entitled to additional earned leave in such proportion of twenty days, as the number of days of vacation not taken bears to the full vacation, provided the total earned leave credited shall not exceed thirty days in a calendar year.

(c) If, in any year, the Government servant does not avail any vacation, earned leave will be as per Rule 26 instead of clauses (a) and (b).”;

(B) in rule 29, for sub-rule (1), the following sub-rule shall be substituted, namely:—

“(1) The half pay leave account of every Government servant (other than a military officer and a Government servant serving in a Vacation Department) shall be credited with half pay leave in advance, in two installments of ten days each on the first day of January and July of every calendar year.”;

(C) in rule 43-C. (a) for sub-rule (1), the following sub-rule shall be substituted, namely”;
“(1) Subject to the provisions of this rule, a female Government servant and single male Government servant may be granted child care leave by an authority competent to grant leave for a maximum period of seven hundred and thirty days during entire service for taking care of two eldest surviving children, whether for rearing or for looking after any of their needs, such as education, sickness and the
like.” ;

(b) for sub-rules (3) and (4), the following sub-rules shall be substituted, namely:-

“(3) Grant of child care leave to a female Government servant and a single male Government servant under sub-rule (1) shall be subject to the following conditions, namely:-

(i) it shall not be granted for more than three spells in a calendar year;

(ii) in case of a single female Government servant, the grant of leave in three spells in a calendar year shall be extended to six spells in a calendar year.

(iii) it shall not ordinarily be granted during the probation period except in case of certain extreme situations where the leave sanctioning authority is satisfied about the need of child care leave to the probationer, provided that the period for which such leave is sanctioned is minimal.

(iv) child care leave may not be granted for a period less than five days at a time.

(4) During the period of child care leave, a female Government servant and a single male Government servant shall be paid one hundred percent of the salary for the first three hundred and sixty five days, and at eighty percent of the salary for the next three hundred and sixty five days.
Explanation.—Single Male Government Servant’ means – an unmarried or widower or divorcee Government servant.”;

(D) for rule 44, the following rule shall be substituted, namely:-

“44. Work Related Illness and Injury Leave:-

The authority competent to grant leave may grant Work Related Illness and Injury Leave ( herein after referred to as WRIIL) to a Government servant (whether permanent or temporary), who suffers illness or injury that is attributable to or aggravated in the performance of her or his official duties or in consequence of her or his official position subject to the provisions contained in sub-rule (1) of rule 19 of these rules, on the following conditions, namely :

(1) Full pay and allowances shall be granted to all employees during the entire period of hospitalization on account of WRIIL.

(2) Beyond hospitalization, WRIIL shall be governed as follows:

(a) A Government servant (other than a military officer) full pay and allowances for the six months immediately following hospitalization and Half Pay for twelve months beyond the said period of six months. The Half Pay period may be commuted to full pay with corresponding number of days of Half Pay Leave debited from the employees leave account.

(b) For officers of Central Armed Police Forces full pay and allowances for six months immediately following the hospitalization and full pay only for the next twenty four months.

(c) For personnel below the rank of officer of the Central Armed Police Forces full pay and allowances, with no limit regarding period.

(3) In the case of persons to whom the Workmen’s Compensation Act, 1923 applies, the amount of leave salary payable under WRIIL shall be reduced by the amount of compensation paid under the Act.

(4) No Earned Leave or Half Pay Leave shall be credited during the period that employee is on WRIIL.”.

(E) rules 45 and 46 shall be omitted.

Booking of Air-Tickets on LTC – DoPT Orders Dt.10.12.2018

Subject:- Procedure for booking of air-tickets on LTC — compliance of instructions regarding

The undersigned is directed to refer to this Department’s O.M. No. 31011 /5/2014- Estt.A-IV dated 24.09.2014, 23.09.2015 and 21.08.2017 on the procedure for booking of air tickets on LTC and to say that as per the extant instructions, whenever a Government servant claims LTC by air, he/she is required to book the air tickets directly from the airlines (Booking counters, website of airlines) or by utilizing the services of the authorized travel agents viz. ‘M/s Balmer Lawrie & Company’, ‘M/s Ashok Travels & Tours’ and ‘IRCTC’ (to the extent IRCTC is authorized as per DoPT O.M. No.31011/6/2002-Est(A) dated 02.12.2009) while undertaking LTC journey(s).

In this regard, it is observed that despite reiterating the above instructions from time to time, this Department still continues to receive numerous references from various Ministries/Departments and individuals seeking relaxation for booking of air tickets for the purpose of LTC through private travel agents. In most of the cases, the common reasons cited by the Government employees are lack of awareness of the rules and work exigencies.

Therefore, all the Ministries/Departments are advised to ensure wide circulation and strict compliance of the guidelines stated in para 1 of this OM.

This point may also be emphasized by the Administration whenever any advance is sought or intention to avail LTC is conveyed by the Government servant. It is stated that henceforth only those cases, where it is established that bonafide mistake has occurred and the Administrative Ministry/Department is satisfied that undue hardship is being caused to the Government servant, shall be considered by this Department for relaxation provided that the information is received in the Proforma enclosed along with supporting documents.

Proforma for sending the request for seeking relaxation for booking of air tickets for the purpose of LTC from private travel agents.

 The Administrative Ministry/Department needs to examine each case on the following parameters and where the Ministry/Department is satisfied that a bonafide mistake has occurred and undue hardship is being caused in any particular case, it may be sent to this Department in the following Proforma along with supporting documents:-

considered for relaxation.
 
4.
 Whether the tickets were purchased at LTC-80 fare or less?

. It may be confirmed/ verified from the concerned airlines whether
the tickets were booked at the same price on the date of booking as indicated
on the ticket?
 
6.
Whether the Govt. servant has availed of any tour package or other
facility from the travel agent except the tickets?
 
7.
The tickets may be checked for any additional, hidden or superfluous
charges. If yes, the same shall not be admissible.
 
8.
Government servant shall submit a self certification to his office/
Administration that he has not availed of any tour package or any other
facility from the travel agent except the tickets.
 

*N.B.— If it is found that any fraudulent attempt has been made by the Government servant to inflate the LTC claim, it shall make him/her liable for appropriate action under Rule 16 of CCS(LTC) Rules, 1988 and the relevant disciplinary rules.

Subject:- Filling up of the post of Member, Staff Selection Commission, New Delhi (Joint Secretary level) in the Level 14 in the pay matrix 144200-218200 on deputation basis.

The undersigned is directed to inform that it is proposed to fill up the post of Member, Staff Selection Commission (SSC) at New Delhi in the Level 14 in the Pay Matrix Rs.144200-218200/-. The eligibility criterion is given at Annexure-I

2. Applications of only such officers will be considered as are routed through proper channel and are accompanied with

(i) bio-data in the proforma at Annexure-II-

(ii) clear photocopies of the up-to-date APAR dossier of the officer containing APARs of at least last five years, duly attested by a Group A’ offcer (if Original APAR could not be sent);

(iii) An attested Statement indicating the grading in the APAR during the last five years

(iv) cadre clearance;

(v) clearance from and disciplinary angle; and

(vi) statement giving details Of major or minor penalties, if any, imposed on the officer during the last ten years.

3. All Ministries/Departments and the State Governments/UTs are requested to forward the applications of willing and eligible officer in the prescribed proforma to:- Section Officer (Estt-B-I), Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), Room. No. 215-C, North Block, New Delhi-110001, so as to reach this OM, on or before 31st December, 2018.

4. The applications of only those officers may be forwarded who, in the event of their selection, would immediately join the duties of the post, and whom the concerned authorities would be in a position to relieve immediately.

The application once forwarded would not be allowed to be withdrawn. Applications received after the prescribed date or not accompanied with the required certificates/documents will not be entertained.

Eligibility Criterion for the post of Member, Staff Selection Commission, New Delhi.

1.Name of Post: Member, Staff Selection Commission, New Delhi.

2.Scale of pay: in the Level 14 in the Pay Matrix Re 144200-218200/–

3.Eligibility: Officers of the Central Government (including officers of All India Services and Central Group ‘A’ Services):

(a) (i) holding analogous post on regular basis in he parent cadre/Department; or

(ii) with five years’ service in the grade rendered after appointment thereto on a regular basis in the Level 13 in the pay-matrix (Rs. 123100-215900) or equivalent in the parent cadre or Department; and

(b) possessing the following educational qualifications and experience, namely:-

(i) post Graduate Degree in a my discipline from a recognized University or Institution; and

(ii) 10 years’ experience in dealing with Service, Administrative, Vigilance, Establishment and Financial matters.

4. Period of Deputation: The person appointed as Member of Staff Selection Commission shall hoki office for a period of five years or till he/she attains the age of 62 years, whichever is earlier.

In case where a serving officer is appointed as Member, he shall be on deputation until he attains the age Of superannuation and thereafter he may be considered for extension of tenure on re-employment terms subject to upper age limit and tenure mentioned above.

5.Age Limit: The maximum age limit for appointment by deputation shall not be exceeding 59 years as on the closing date of the receipt Of applications.
