My date of joining is 02/05/2008 and macp-1 due on 02/05/2018, basic pay currently 36400/-, grade pay 2400 , what option should i choose for my pay fixation…date of next increment or date of promotion ???? Where will be more benefit to me ????

Choose joining date i.e. from 2-5-2018 as completed service of 10 years if you have not got any promotions so you will be befitted 60 days ahead you advance increment is getting earlier otherwise it will be from 1-7-2018 onwards.

It’s seems after your increment as on 1-7-1918 of Rs.60,400/- in matrix level 6 to 7 as on MACP upgradrations from 30-8-18 as advance increment of Rs.62,200/-, so you will not get increment on 1-7-19 and your basic pay will get in matrix level 7 in pay of RS.64,100/- from 1-7-20 as higher level increment.

Sir, I was appointed as Inspector in CBIC on 04.05.1974. Got my first promotion on 26.08.1991. As per ACP orders I got my Pay
notionally of Assistant Commissioner Cadre wef 09.08.98. I got my actual promotion to the cadre of Assistant Commissioner on 10.01.2007 which involves discharge higher responsibility interns of GO dt. 01.07.1997.
My question is….Am I not eligible for one minimum increment under the concept of higher Pay for higher responsibility?
I got my further benefit under MACP wef 01.09.2008.

No. Since the grade was not changed. If grade pay changes basic’ pay plus GP added to 3% as new basic pay. Have you got 3rd MACP upgradrations on completion of 30 years service ?

Sir I’m Geetha from TNSTC Senior Supdt. My present basic is Rs.5799.00. Next increment due on Jan 2020. If I get promotion as Asst. Manager post can I give option for my pay fixation after my increment in Jan 2020.

Nobody will get increment on JANUARY, 20 & no promotional pay benefits. Only pay benefits through MACP on completion of every 10 th year as upgradration of pay fixations in the 7th CPC onwards.

Your pay as 1-7-18 as ₹ 49000 as level 6 (4200) & 1-7-18 as 50,500 in level 7 (4600). Increment in July only.

There’s no pay benefits in promotions from 7th CPC. Only your Designation changes higher.

From the 7th CPC in the Promotions no monitory benefits, only designation changes higher. Completion of .10 years without any Promotions they will be given MACP as upgradrations of basic pay in next matrix level in the 11th year onwards.

No option for Promotions. As usual increment on 1/7/19 in same Matrix Level.

Sir my current basic pay is 58600 rs & MACP is due on 20/04/2020.
presently my pay level 7.
My Next pay is what and next increment due date please mention sir?

If Your basic pay as 1/7/19 as ₹ 58,600, at MACP from 20/4/20 (give option) is given as advance increment of ₹ 60,400 in level 7 and no increment on 1/7/1920. Next DNI on 1/7/21 as ₹ 62,200/- in level 8.


Question: VIJAY KUMAR GUPTA asked (June 28, 2019)
I was drawing my pay Rs. 75600 till December 2018 in the pay level of 9 and holding the post of AO. I have been promoted as Sr.AO in the level of 10 from 01.01.2019. I could only join my upgraded post of Sr.AO on 07.01.2019 and opted my pay fixation from the date of next increment (DNI) which falls on 01.07.2019. My office has fixed my pay on DNI as Rs. 82400 in level 10 by following Rule 13 of pay rule 2016 and allowed me to draw my pay in the upgraded pay (Level-10) @ Rs. 77700 (being the higher pay in next level-10) from 07.01.2019 to 30.06.2019. But they indicated the DNI as July 2020 in the pay fixation fixation order.
Department of Expenditure, MoF had circulated OM dated 31 July 2018 stating that if some one as opted to get his pay fixed with DNI then his pay will be fixed as per rule 13 and he is entitled to get his first annual increment in the upgraded scale on completion of minimum qualifying period of 6 months and subsequent increment will be granted on annual basis. This is the main spirit of the OM.
In my case, being opted for my pay fixation from the date of next increment (DNI) i.e. 01.07.2019 even join the post of Sr.AO from 07.01.2019, my pay has been fixed correctly @ 82400 but they indicated DNI as 01.07.2020 which appeared not as per the OM dated 31.07.2018.
Please clarify whether my DNI will be 01.01.2020 or 01.07.2020.

If your upgrade basic pay as your MACP on completion of 10/20/30 years it is correct as per rules. Nobody will get annual increment on January month. Since you got the advance increment from 7/1/19, you are not eligible for increment on 1/7/1999 your upgrades Matrix Level 10 from 1/7/20 as ₹ 82,400/-.

You give your opinion from the MACP upgradrations from 8/7/2019 as on your basic pay will be ₹ 36,400/- of advance increment and no increment on 1/7/2020. Your next increment of ₹ 37,500/- from 1/7/2021 as in matrix level 5.

It seems you have re-employed in other institution after volunteer retirement
hence second commutation will also restored after completion of 15 years from
the amount received if it is in 2007 it will recovered in 2022.

Those completing six month or more period of duty/service on a given
stage under 6thCPC before 30th june are also eligible for increment on 1st
July.Under6CPC employees retired on 30th June may fall into two
categories-those who got their last increments exactly one year back but
retired on 30th June. Second category include those retirees who got
promotion to higher post between 2nd July and 31st December and have thus
completed 6 or more months making them eligible for next increment on 1st
July immediately following the date of their retirement on 30June,the
preceding day. Further it added that under FR26(a) all duty on time scale
counts for increment in that time scale. Since Fundamental Rules are framed
under article 309 of the Indian Constitution, no authority in administration
can deny the benefit of his/her duty as government whether it is given to
employees on actual basis or to retirees of 30th June on notional basis. This
is the position of FR26 since 1967.Unfortunately under government the date of
increments remained changing in the past The peculiar case came only when
under 6thCPC a uniform date of increments is fixed as July 1st.The position
of qualifying Duty/service under FR 26 for increment rendered by retirees of
30thJune deserves favourable clarification for grant of increment on July
1st. Government must come forward with speaking decision as to how it intends
to give the reward of services rendered to government. It is done for the
employees who are continuing in service but how can a government forfeit the
benefit of FR26 framed under article 309 of the Indian constitution the
retirees of June30th.

I’m retired from AMC in the rank of Sub (ACP-1) Group Y with 28 years
service on 31 Mar 2016 with BP-15960, GP- 4800 & MSP-2000. My Pension was
fixed as per 6th CPC BP Rs 12285/- as per PCDA (P) circular 501 do 17 Jan
2013 and DP Rs 4097/- for 60% for life. On implementation of 7th CPC it has
now fixed BP Rs 29400/- & DP Rs 10584/-. Is it OK?

I served in Indian Army from 25 Nov 1963 to 30 Nov 1985 ( 22 years ).
I was re-employed at Indian Grassland Fodder Research Institute JHANSI (UP)
0n 06 May 1986 as Junior Clerk. My pay was Fixed but they have NOT included
my Army service from Sepoy/Clerk to Naik Clerk ei 29 Apr 1965 to 28 Apr 1967
and 29 Apr 1967 to 28 Feb 1972 (say 7 Years). They have granted only 14 increments
for the post of Havildar Clerk. During service, I could not see the personnel
file, before retirement,when I retiring at the age of 60 years and preparing
the personnel documents, I saw that they have not included 7 increments for
the rank of Sep to Naik. After retirement I requested

Sir,
I am directed to say that as per extant instructions,non functional Grade pay of Rs.5400 in PB-2 (per-revised) is granted to those Superitendents/ Appraisers who have completed 4 years who was granted Grade pay of Rs. 4800/- Shri M.Subramaniam,the then Inspector who was granted Grade pay of Rs. 4800/-due to ACP scheme, got favorable judgment from the Hon’ble Supreme Court.Review Petition in the said case was also dismissed by the Hon’ble Supreme Court.

2.Consequent upon dismissal of Civil Appeal No.8883/2011 and Review Petition in Civil Appeal filed by UOI by Hon’ble Supreme Court,the judgement of Hon’ble High Court of Madras in M. Subramaniam has been implemented in consultation with D/o Expenditure.

3.Keeping in view a number of similar court cases in different Benches of CAT/Court being decided by CAT/High Court, in favour of petitioners,the matter was examined in the Board and a proposal was referred to D/o Expendiutre up consider extension of the direction of the Hon’ble Court in M.Subramaniam,to all similarly placed officers. Deptt of Expenditure vide note dated 12.11.2018 examined the matter and sought following clarifications:-

(i) How many individuals of which posts have been allowed the benefit so far?
(ii) How many similarly placed persons are to be covered in the benefit?
(iii) Whether the similarly placed persons are holder of the same post which was held by the individuals covered in the SLP?
(iv) The financial implications on the benefit already allowed and the estimated fiancial implication on the similarly placed employees?

4.The details sought by D/o Expenditure vide note dated 12.11.2108 needs to be compiled from the Zonal Commissionerates. You are requested to kindly obtain the details/information on the points mentioned above from Zonal Commissionerate, compile it and furnish the same to the Board for taking up the matter with D/o Expenditure.

Since a number of court cases are pending in CAT/High Court, it is requested to expedite this exercise and detail/information be made available to the Board, by 20.12.2018.

DEFEAT THE RULING CLASS POLITICS BEHIND IT.

National Secretariat of Confederation unanimously decided to make the two days nation-wide strike on 2019 January 8th & 9th a grand success in the Central Govt. Employees Sector.

The decision of the Central Headquarters to postpone the one day strike on 15-11-2018 and to organise two days nationwide strike on 2019 January 8th & 9th is ratified by the National Secretariat.

Strike will be organised on 10 points charter of demands of Confederation (reproduced below). First and most important demand of the strike will be “Scrap NPS & Restore OPS”. In connection with the strike, following decisions are taken.

1. Strike campaign is most important. The message of the strike and the demands raised should reach each and every Central Govt. employee and pensioner. Notices, pamphlets, posters etc. should be printed and circulated among all employees.

Maximum campaign through websites, journals of affiliates, print and electronic media and social media should be made by each affiliated Unions/Associations/Federations and C-O-Cs. The campaign should be intensified in the coming days.

2. Each affiliated organization of Confederation should issue separate circulars to their lower units instructing them to participate in the two days strike and also to organise intensive campaign programmes for ensuring 100% participation of employees of each affiliate in the strike.

It is noticed that, during previous strikes, some of the affiliates had not issued any separate circulars and no specific instructions to participate in the strike was given to their lower units. This has created problem for other organisations also at the lower level. This time every affiliate should issue their own circulars to lower units.

3. All State/District level C-O-Cs should convene their managing body meetings immediately and work out detailed plan for intensive campaign among the employees under their jurisdiction. C-O-Cs should play an effective and leading role in making the strike a grand success.

4. All affiliated organisations should plan and announce their own separate campaign tour programme of their leaders for organizing strike at all centres and all offices.

This is most important. Unless the leaders of affiliates make their own campaign tour programmes, the strike cannot be organised in an effective manner in all units.

5. Confederation National Secretariat Members will be visiting only selected important centres in each state for campaign meetings. The tour programme of National Secretariat members will be published shortly.

Programme may be finalized by mutual consultation of C-O-C leaders and National Secretariat members concerned. (Campaign by each affiliate and C-O-C is given top most priority as the National Secretariat members are attending limited meetings only.)

6. Strike notice should be served by each affiliate separately to their departmental head on 12-12-2018 (6th anniversary day of 12-12-2012 one day strike). Confederation Central headquarters will serve strike notice to Cabinet Secretary on 12-12-2018.

Copy of the strike notice should be served to all lower authorities also organizing mass demonstrations of maximum employees. Complaints are received that some of the affiliates never serve separate strike notice to their Departmental head and also never circulate the copy of the strike notice served to lower units.

As a result, when C-O-C leaders approach, their lower unit leaders say that they have not received any instructions from their Central headquarters to participate in the strike. This time Central Headquarters of all affiliated organisations should serve strike notice to their departmental heads and should also issue instructions to their lower units to participate in the strike.

Affiliation of those organisations which are not serving strike notice or issuing instruction to their lower units to participate in the two days strike will be withdrawn, as their is no meaning in continuing the affiliation of those organisations which do not implement the decision of the National Secretariat of Confederation.

7. If due to unavoidable circumstances, any organisation cannot serve the strike notice on 12-12-2018, they may serve the strike notice on any other day before 23-12-2018.

8. Even though all the leaders of Confederation and its affiliates are well aware of the full details of each demand raised in the 10 point charter of demands including NPS, it is decided to publish detailed note on each demands in the Confederation website in coming days as campaign material and talking points.

9. As almost all Central Govt. employees and pensioners are agitated over the unhelpful and negative attitude of the NDA Government, there is every possibility of making the two days strike a thundering success, provided the leadership of each affiliates and C-O-Cs rise upto the occasion and start mobilization now onwards with all seriousness.

Our wages and other benefits are under attack.
Our job security is under attack.
Our social security is under attack.
Our trade union rights are under attack.

Let us intensify our struggles from defensive to offensive and defeat the anti-worker policies of the Government. Central Govt. employees can do it under the banner of Confederation.

Make the two days strike historic success. Remember, we are not alone, the entire working class of India belonging to Banks, Insurance, BSNL and other public sectors, State Govt. employees and Teachers etc. etc. are all on strike on 2019 January 8th & 9th.

Don’t be a spectator, join the strike proudly and be a part of the fighting working class of India. Our slogan is “change the disastrous neo-liberal policies, or else we shall change the Government”.

OBSERVE 2018 DECEMBER 12 as “SCRAP NPS & RESTORE OPS” DEMANDS DAY

National Secretariat of Confederation has decided to observe 12th December 2018 (strike notice serving day) as Demands Day raising the demand – “Scrap NPS & Restore OPS” throughout the country.

All affiliates and C-O-Cs are requested to observe the day in a befitting manner by conducting demonstrations in front of all offices, organizing gate meetings/general bodies and also wearing badges with the slogan – “Scrap NPS & Restore OPS”.

The struggle against NPS is getting intensified day by day. Delhi State Govt. has passed a resolution in the State Assembly demanding the Central Govt. to scrap NPS imposed on Delhi State Govt. employees.

State Govts. of Kerala, Andhra Pradesh and Tamilnadu has already appointed Expert Review Committees to submit recommendations regarding modalities for scrapping of NPS and restoring OPS. Tamilnadu State Government employees and Teachers (all organisations) have decided to organise indefinite strike demanding scraping of NPS and restoration of OPS.

Confederation is in touch with other organisations in Central Sector and is exploring the possibility of organizing higher form of trade union action including indefinite strike.

After the two days strike on January 8th & 9th, an All India Convention of NPS employees along with other like-minded organisations will be organised. Our ultimate aim is to organise an indefinite strike, no sooner than later, exclusively on one demand ie; “scrap NPS & Restore OPS”.

3. All India Trade Union Education Camp of Confederation:
National Secretariat meeting decided to organise an All India Trade Union Camp of Confederation. Venue, date etc. will be finalized in consultation with C-O-Cs shortly and detailed circular will be issued thereafter.

4. All India Women’s Trade Union Education Camp – Haridwar – A grand success:
All India Women’s Trade Union Camp of Confederation was held at Haridwar (Uttarakhand) on 29th & 30th October, 2018. Com.Subhashini Ali, Ex-MP, inaugurated the camp by taking a class on the subject – “Indian Working Class – Challenges and opportunities”.

Second class was by Com.Keerthi Singh, Advocate, Supreme Court on the subject – “Women’s social status and rights in the Indian Society”. Third class was by Com.T.K.Rajalakshmi, Editor, Frontline on the subject – “Media and Politics”.

Concluding session was on the subject – “Scrap NPS & settle Confederation’s 10 points charter of demands – significance of 2019 January 8th & 9th two day’s strike”. Com.M.Krishnan, Secretary General, Confederation, Com. Giriraj Singh, President, NFPE, Com.Vrigu Bhattacharjee, Secretary General, National Federation of Civil Accounts Employees Associations, Com.S.B.Yadav, General Secretary, All India Postal Accounts Employees Association, Com.Worlikar, National Federation of Atomic Energy Employees, Com.D.B.Mohanthy, General Secretary, P4 Union (NFPE), Com. Virendra Tiwari, General Secretary, All Idnia Potal SBCO Employees Association addressed the concluding session.

The Camp was presided by Com: Usha Boneppalli, Chairperson, Women’s Sub Committee who delivered a thought provoking presidential address. Com.R.Seethalakshmi, Convenor, Women’s Sub Committee made introductory speech. Com.Geetha Bhattacharjee and Com.Manisha Majumdar offered welcome address and vote of thanks on the second day.

Com.Virendra Tiwari, Working Chairman of the C-O-C, UP State Committee and Chief Organiser of the camp welcomed the distinguished guests, leaders and delegates during the inaugural session. Com: Anilkumar Chowdhary, Circle President, P4, UP Circle (Shaharanpur Division) presented special shawls to all guests and leaders. The camp concluded at 02.30 PM on 30-10-2018.

The Reception Committee made excellent arrangements for the camp. Confederation National Secretariat congratulates the entire UP C-O-C comrades and convey our thanks to them for successfully organizing the two day’s camp.

2019 JANUARY 8th & 9th TWO DAYS ALL INDIA STRIKE

CONFEDERATION’S COMMON CHARTER OF DEMANDS OF ENTIRE CENTRAL GOVT. EMPLOYEES, AUTONOMOUS BODY EMPLOYEES, GRAMIN DAK SEVAKS, CASUAL/CONTRACT WORKERS AND CENTRAL GOVERNMENT PENSIONERS.
(adopted by the National Convention held at Hyderabad on 10th June, 2018)

1. Scrap New Contributory Pension Scheme (NPS). Restore old defined benefit pension scheme (OPS) to all employees.

2. Settle 7th CPC related issues including increase in Minimum Pay and Fitment formula, HRA arrears from 01-01-2016, MACP Bench Mark, promotional hierarchy and date of effect of MACP from 01-01-2006. Implement Option-1 for pensioners and settle all anomalies arising out of implementation of 7th CPC recommendations.

3. Fill up all vacant posts. Reintroduce Regional Recruitment for Group B & C posts. Withdraw orders for abolishing posts lying vacant for more than five years. Revive all posts abolished during 2001 to 2008 under Annual Direct Recruitment Plan (ADR) as per May 2001 orders of the former NDA Government.

4. (a) Regularisation of Gramin Dak Sevaks and grant of Civil Servant Status. Implement remaining positive recommendations of Kamalesh Chandra Committee report.
(b) Regularise all casual and contract workers including those appointed on or after 01-09-1993.

5. Ensure equal pay for equal work for all. Remove disparity in pay scales between Central Secretariat staff and similarly placed staff working in field units of various departments.

6. Stop closure of Government establishments and outsourcing of Government functions. Withdraw closure orders of Govt. of India Printing Presses. Stop proposed move to close down salt department. Stop Foreign Direct Investment (FDI) in Railways and Defence departments.

7. Implement 7th CPC Wage revision and pension revision of Autonomous body employees and pensioners. Grant Bonus to Autonomous body employees pending from 2016-17 onwards. 8.

Remove 5% condition imposed on compassionate appointments and grant appointment in all deserving cases. Rejected cases for want of 5% quota vacancies may be reviewed and appointment to dependents may be granted.

9. Grant five time bound promotions to all Group C & B employees on completion of 8,7,6,5 and 4 years of service respectively. Complete Cadre Reviews in all departments within a time frame.

10. (a) Stop attack on trade union rights. Ensure prompt functioning of various negotiating forums under JCM scheme at all levels.
(b) Withdraw the draconian FR 56(j) and Rule 48 of CCS (Pension) Rules, 1972,

(If necessary, affiliates can add their own department – specific demands as PART-II of the Charter of demands).

Justice L. Narasimha Reddy:-

This OA is filed with a prayer to direct the respondents to revise the pre-revised scale of pay of the applicants to the one Rs.7500 to 12000 instead of Rs.7450 to 11500 w.e.f. 01.01.2006.

They seek further direction to upgrade the post held by them to the one of Accounts Officer/Audit Officer in the scale of Rs.5400 in PB-2 instead of Rs.4800/- and for further revision of pay scales.

BOMBAY High Court Judgment dated 15-10-2018 on MACPs
ORDER

(a) The impugned judgment and order dated 16th April, 2013 made by the CAT is hereby set aside.

(b) The petitioner is held entitled to receive the benefit of MACP with effect from 1st January, 2006 together with all consequential benefits.

(c) The respondents are directed to work out the benefits of MACP with effect from 1st January, 2006 together with consequential benefits and to pay the same to the petitioner as expeditiously as possible and in any case within a period of three months from today.

d) If, such benefits/consequential benefits are not paid to the petitioner within three months from today, then the respondents will liable to pay interest thereon @ 6% p.a. from the date such payments became due and payable, till the date of actual payment.

(e) Rule is made absolute in the aforesaid terms. There shall however be no order as to costs.
